Hi, I want to make some clarifications about this article published in Sott:

Has Maduro really dissolved the National Assembly in Venezuela?

For me the article is tendentious because it seems to omit some facts that can help to arrive to a more objective conclusion. At this moment the supreme court reversed the articles that removed the competency of the national congress (surely by a inner faction against it and inner and foreign pressure over the government), but the damage is already done. This was so, because yesterday, the General prosecutor of the Nation, which is a Chavez follower said "These judgments (of the court) show several violations of the constitutional order and ignorance of the model of state enshrined in our Constitution of the Bolivarian Republic of Venezuela, which constitutes a rupture of the Constitutional Order " which is something nobody expect from her, being that she has been silent about other aberrations. So this article ease up something which is a serious fact, making it appears as a purely legal conflict. This was a plain auto coup d'etat intent. The decisions of the congress are not accepted (goods of bad for the nation) by any of the other power branches of the government since its installation, so virtually the congress doesn't exist, it is just now that was made a disguised official new .

This is really a political conflict using the malleability of law. I understand the background of this conflict which at higher levels have to do with imperialist domination, but this was really a bad move of the government, even more that few days ago the OEA (organization of American states ) accused Venezuela to be a dictatorship and threatened to remove it from the organization if the necessary votes are reached (with economical, political and military bad consequences for the country).

Some points:

The congress is in power of the opposition, that won with two thirds of the majority in December 2015 which gives big powers . To have less that 2/3 made the party's negotiate, so just before the new congress was installed, the former pro-government congress chose (violating the procedure) some judges (that do not meet the requirements, and some of the are even losers candidates for the new congress) for the constitutional court of the supreme court. This new ones illegitimate judges opened a case accusing 3 opposition deputies of the Amazon state of having won by cheating. In this way they cut the 2/3 and short the power of the opposition and force it to made negotiated decisions. Until the moment they can't prove those deputies made cheating. So this is a make up case.

It was supposed that the court had to made an investigation and order to celebrate a new election for those 3 deputies. You can't leave an entire state of the country without representation in the parliament, but they don't move a finger for do that because if they repeat the election in that state, are going to loose again and the opposition will recover his 2/3 majority. In fact they said that the investigation corresponds to the electoral national council which also didn't do anything to solve the conflict and a year has passed since that. The article said the the conflict is in hands of the opposition but the opposition do removed the 3 deputies on January 13. (_http://www.bbc.com/mundo/noticias/2016/01/160113_venezuela_mayoria_oposicion_asamblea_dp) and that didn't stop the conflict. So the opposition incorporated again those deputies and finally remove them again after conversations with the government, but nothing change.

So this is not an issue that is on the hands of the opposition but the government principally. I understand that maduro don't want to restore the power of a congress that is against him, but maduro needs to understand that the congress has a lot of legitimacy, even more than the supreme court that is chosen by the Congress in a secondary way. It is also worth to mention that all the votings has been suspended in the nation since a year by legal tricks: a constitutional referendum to remove maduro, which complied with all the requirements of the law, and which Chavez submitted also in the past, elections of governors, majors, elections in labor unions, etc. So this is near a dictatorship. Even Maduro said: " "When there are elections, that the CNE convoke them, I do not know when, in what year (my note: Why if there is an electoral schedule well established?), when we get back to the electoral field, we must be assured the victory with political force, with popular force, with the millimeter organization of the new Stage. "(http://www.laizquierdadiario.com.ve/Maduro-alude-a-indefinicion-convocatoria-a-elecciones?id_rubrique=5442). This is, there is no more elections while maduro and chavism lose them.

This is really bad for any progressive government that wants to reach power in any country in L.A, this bad experience will be used over and over again as example of what happens if you allow a progressive government reach power, sadly. Tomorrow will be President election in Ecuador, let's see what happens.

The controversy between the Venezuelan Supreme Court and the country’s National Assembly has been overcome, Venezuelan President Nicolas Maduro has announced.

The statement was read out by Venezuelan Vice President Tareck El Aissami after a Security Council meeting.

The Council urged the Supreme Court to review its Wednesday ruling on assuming parliamentary powers of the National Assembly "in order to maintain institutional stability and balance of powers through the remedies provided for in the Venezuelan legal system," according to a statement posted on the official account of the Venezuelan presidency.

The Venezuelan Supreme Court ruled out to return legislative powers to the country’s parliament, the National Assembly, according to media reports.

The Venezuelan Supreme Court has decided to return legislative powers to the country’s parliament, the National Assembly, and immunity to its lawmakers, media reported Saturday.

On Wednesday, the Supreme Court of Venezuela ruled that it would assume the powers of the National Assembly, controlled by the opposition majority.

According to the Blu Radio, the constitutional chamber of the Supreme Court has passed two "clarifying" regulations, which cancel rulings on assuming the parliamentary powers and depriving lawmakers of the National Assembly of their immunity. The documents were published on Saturday morning after the meeting of the Security Council headed by Venezuelan President Nicolas Maduro.

Earlier in the day, Maduro said the controversy between the Venezuelan Supreme Court and the country’s National Assembly had been overcome.

As Venezuela faced a new spiral of political crisis with a supreme court's attempt to cease power from the parliament, South American trade bloc Mercosur urged Caracas to ensure separation of powers in the state.

Mercosur called on Venezuelan authorities to ensure separation of powers in the country during an emergency meeting devoted to the Venezuelan Supreme Court's decision to assume the functions of the country’s parliament, Mercosur said in a joint statement.

"It is necessary to take concrete measures together with the opposition and in accordance with constitution to ensure effective separation of powers and respect for human rights," the statement read out by Argentinian Foreign Minister Susana Malcorra said.

The decision on assuming parliament's powers was announced by the court on Wednesday, and triggered sharp criticism around the world. Such countries as Colombia, Chile and Mexico expressed their concern over the court's decision, while Peru recalled its ambassador from Venezuela. Early on Saturday, the Venezuelan Supreme Court decided to return legislative powers to the National Assembly, and immunity to its lawmakers.

Venezuela is currently in the state of economic emergency, announced by country's President Nicolas Maduro in January 2016 amid widespread food shortages, hyperinflation and anti-government protests.

In October 2016, the parliament voted for initiating impeachment proceedings against the president, which were later dismissed by the Venezuelan government. On January 9, the parliament declared that Maduro abandoned his post as result of dereliction of duty, but the Supreme Court of Justice stated that the National Assembly did not have the constitutional powers to declare abandonment. Maduro classified the parliament’s actions as a coup attempt.

Mercosur, founded in 1991, is a sub-regional economic bloc that includes Argentina, Brazil, Paraguay, Uruguay and Venezuela and is aimed at promoting free trade and free movement of goods, people and currency. Venezuelan membership was suspended in 2016 due to its alleged failure to fulfill economic, human rights and immigration requirements and presidency in the bloc was handed over to Argentina.

Hi Angelburst as I said the court reverse the decrees against the national assembly, I wish it were so simple, but that doesn't mean that the congress would be left to work normally, and the conflict is gone,no, because since the very beginning has been ignored, even before it was installed. There is no government interest in solving this problem. So it is natural the parliament treat by all mediums, legals and no so much (as maduro/government did too) try to gain its own control. This not mean that yesterday we were in a dictatorialship-like country and now with the reverse of those decrees we have a more democratic one because they recoil. The bad is already made, and his really intentions showed, and this stupid actions of the government will allow an easy interference of the OEA, Mercosur and other countries USA- aligned attacking Venezuela. What is next to come looks very bad. :(
