DUKE ENERGY CAROLINAS' MOTION TO DISMISS ANY CITIZEN'S OBJECTION TO DUKE ENERGY CAROLINAS' "UPGRADE" OF A BUNNY TO A BRONTOSAURUS

NOW COMES Duke Energy Carolinas, LLC (herein referred to as Duke Energy) pursuant to rule ID-10-T of the NC Common Sense Code, and files its Motion to Dismiss Any Citizen's Objection to Duke Energy's "Upgrade" of a Bunny to a Brontosaurus.

WHEREAS,
The words "Bunny" and "Brontosaurus" both begin with the letter "B"

AND WHEREAS
The words "Bunny" and "Brontosaurus both contain the letters "U" and "N"

AND WHEREAS,
Both a Bunny and a Brontosaurus have 1 head, 1 tail and 4 legs each respectively

AND WHEREAS,
A Bunny and a Brontosaurus are both herbivores

AND WHEREAS,
A Bunny and a Brontosaurus are "similar" in nature and as such Duke Energy's "Bunny to Brontosaurus Project" is not subject to any statutory regulation and/or certification process due to its status as an "Upgrade" of an existing herbivore.

AND WHEREAS,
Duke Energy predicts that the demand for herbivores will increase, even though current usage is actually dropping due to conservation measures and various economic factors.

AND WHEREAS,
To date, there is not one single laboratory study proving that a Brontosaurus in a Citizen's backyard is any more hazardous or potentially damaging to the Citizen's heath and well being than a Bunny.


WHEREFORE, Duke Energy moves that the Commission wave all Rules of Common Sense and
(i) Order that Respondent's "Bunny To Brontosaurus Upgrade" is plainly exempted from any CSR (Common Sense Requirement) by the Commission.
(ii)grant its Motion to Dismiss the Citizen's Complaint for failure to state a Bunny to Brontosaurus claim upon which relief can be granted.
(iii) grant such other relief as the Commission deems necessary.

I just posted the "Bunny to Brontosaurus" spoof to the Save Kituwah Facebook page, and these are the responses I'm getting. These people (our supporters) want to know if it's real.

Ok, now I'm starting to think it's me??? Yet another person took it seriously. This woman thinks "Bunny to Brontosaurus" Motion is real, and Duke filed it as a joke??

These are not stupid people...at least not all of them. I don't know "Beth Wallace" but her comments up to this point seem fairly intelligent and well thought out.

Is my sense of humor seriously "off" and I just don't see it ...or is it something else?

The page is getting a lot of attention (more than the real Motions) which was what I intended/hoped for...but I thought it was a pretty clear cut parody?

Duke's attempt at humor is a disgrace to all indigenous people's ancestors. I know they played this to the Upgrade issue but there were other insinuations there. (The dinosaurs inference was not lost on me nor should it be on you.) It is disrespectful and irreverent to the Cherokee People as well as the Energy Commission. This is not a contest... See More as to which party has the best sense of humor. When dealing with any suit, hearing, court, it is imperative to be civil, courteous, and respectful. I think Duke's insolent attitude in this Answer just showed how they really feel. They also showed their flipness to the Energy Commission. Wise? I think not. This piece of drivel will not go over well. If they wish to use metaphors, comparing a bunny to a brontosaurus, then they should be prepared to face the words Foolish-attempt to Futile-end. They know the outcome of David Vs Goliath. Take heed, Duke. (Impressive staff of attorneys you have, Duke. Cracker Jack Box Juris Doctorates?)

Humor is often lost on those who are thinking with their emotions. It's an emotional issue for people, so - maybe - that emotion is preventing them from thinking clearly? Or, they're just dumb. ;) So, are you explaining to these folks who take it seriously that it's a parody?

The "Bunny" is the ordinary wooden pole most of us have in our backyards, and the "Dinosaur" is the 125' metal monuments to fossil fuel consumption Duke wants to (and has) put in people's backyards.

It's a parody of Duke's definition of "Upgrade" in their Motion....although I'm getting the impression I might have made it look a little too real for some folks?

This brings up something I'm not sure everyone understands?
The North Carolina Utilities Commission DOES NOT have jurisdiction over the proposed Tie Station at Kituwah. The Utilities Commission ONLY has regulatory authority over the Transmission Lines and Towers which would eventually connect to the proposed Tie Station.

As yet, no towers have been built in Kituwah Valley, the Swain County Moratorium stopped construction right before they came over the ridge.

Of course if we can stop the construction of the 161kV transmission lines, there is no need for a Tie Station near Kituwah :-)
