Religious circumcisions are crimes says court

Religious circumcisions are bodily harm and thus a crime, a German court ruled this week, in what was dubbed a precedent-setting decision.



Non-medical circumcision is a "serious and irreversible interference in the integrity of the human body,” the Cologne district court ruled.

This criminalises religious circumcisions performed by Jews and Muslims, the Financial Times Deutschland newspaper said on Tuesday. It says circumcision should be considered a crime of bodily harm.

Thousands of very young boys are circumcised in Germany each year, mainly for religious reasons.

In the United States most boys are circumcised shortly after birth - regardless of their religion, though the practice has declined in recent years and anti-circumcision protest groups have sprung up.

German doctors performing circumcisions that are not medically necessary have until now operated in a grey legal area. Until now they could claim that they were unaware that performing a circumcision is a crime.

Even if a physician was later found guilty by a court, there was a legal loophole and he could claim that the law was improper and avoid punishment. That is no longer the case, the Financial Times Deutschland said.

"The ruling is enormously important above all for doctors because it's the first time that they have a legal certainty," Holm Putzke of the University of Passau told the paper. He has been calling for prohibition for years.

“The court has, in contrast to many politicians, not allowed itself to be scared by the fear of being criticised as anti-Semitic or opposed to religion,” Putzke said.

"This decision could not only affect future legal rulings but in the best case it could lead to a change of consciousness among the affected religions when it comes to respecting the basic rights of children."

Jewish and Muslim groups have fought for years against a criminalisation of circumcision. They did not have any immediate comment on Monday's ruling, saying they needed to review it first, the paper said.

The court ruling is likely to be highly controversial – experts expect the matter will end up being decided by the Federal Constitutional Court.

The Cologne decision came after a Muslim doctor performed a circumcision on a four-year-old boy. Two days later the mother brought the child to the emergency room because he was bleeding.

The prosecutor's office learned of the situation and filed charges against the doctor. The doctor was found not guilty in the first instance, but the prosecutor appealed.

I assume this will also apply to the horrendous practice of 'female circumcision' which is by far more intrusive and maiming that male circumcision.

Thank you Shane, and seriously I am not at all in favor of male circumcision - to think that it is done,or at least has been done, on babies without anesthetic. But google up female circumcision - I suppose the parallel 'operation' in terms relating to the male genitalia would be amputation of the penis. There are also rituals in which the vagina is sewn shut until marriage.

Female circumcision has been reported to be occurring in Britain, and could well be occurring in other more generally 'non-Islamic' countries, where there is a portion of the population that is Islamic.
 
This may be the best news I've heard lately! It'd be nice if this spreads and encompasses all circumcision--seeing it for the cruel and traumatizing practice that it is--but I'm certainly not holding my breath anytime soon.

BERLIN (Reuters) - Jewish and Muslim groups protested on Wednesday after a German court banned the circumcision of young boys for religious reasons in the first ruling of its kind in the country.

The court in the western city of Cologne handed down the decision on Tuesday in the case of a doctor prosecuted for circumcising a four-year-old Muslim boy who had to be treated two days later for post-operative bleeding.

It ruled involuntary religious circumcision should be made illegal because it could inflict serious bodily harm on people who had not consented to it.

However the ruling, which applies only to the Cologne area, said boys who consciously decided to be circumcised could have the operation. No age restriction was given, or any more specific details.

The doctor, who was prosecuted after the hospital doctor who treated the boy for bleeding called police, was acquitted as there was no law banning religious circumcision at the time.

The Central Council of Jews in Germany called the ruling an "unprecedented and dramatic intrusion" of the right to religious freedom and an "outrageous and insensitive" act.

"Circumcision for young boys is a solid component of the Jewish religion and has been practiced worldwide for millennia. This religious right is respected in every country around the world," President Dieter Graumann said in a statement.

"INTERFERENCE"

The Central Council of Muslims in Germany called the sentence a "blatant and inadmissible interference" in the rights of parents.

"Freedom of religion is highly valued in our constitution and cannot be the play-thing of a one-dimensional case law which, furthermore, consolidates existing prejudices and stereotypes," it said in a statement.

According to the court ruling, "the fundamental right of the child to bodily integrity outweighs the fundamental rights of the parents".

"The child's body is permanently and irreparably changed by the circumcision. This change runs counter to the interests of the child, who can decide his religious affiliation himself later in life," it said.

Germany is home to about 4 million Muslims and 120,000 Jews. In Judaism, eight-day-old male infants are circumcised to recall the covenant established between God and the Hebrew patriarch Abraham.

The time for Muslim circumcision varies according to family, region and country.

Concerned the ruling could be followed in other parts of the country and that it could prevent doctors carrying out circumcisions for fear of prosecution, the Central Council of Jews urged the German parliament "to provide legal clarity in order to prevent attacks on religious freedom".

The World Health Organisation estimates 30 percent of men worldwide are circumcised.

In countries including the United States, many parents cite health reasons for having boys circumcised, saying it improves hygiene and can cut the risk of the spread of disease.

Female genital mutilation is forbidden across Germany.

It is indeed good news! I get the feeling that one of the reasons they banned it is that now those who demand FGM can't say they're being discriminated against.

Also Google 'sub incision' and you'll see the male version of FGM. It was practiced in a number of countries. Bizarre! There are even fora for men who's hobby it is to mutilate their own genitalia. Not for the faint hearted.

It looks like at the moment that especially Rabbis complain about it and that the government thinks about to find exceptions for religions, since it is one of the highest goods: freedom of religion. Well, so children are of little importance compared to religions it seems. One rabbi told „it is the worst attack against the life of Jews since the holocaust“. So the trump card in Germany got played out already.

On the other hand children's aid is raising it's voice for the children.

Let's wait and see.

I wonder where this is going to lead, given the 'fury' and manipulative pity ploy elicited in jewish circles. According to a German article there's a bunch of 'donators' from Israel, the US and Europe, who have already paid millions into a fund to battle the court's decision. The jewish multimillionaire Edi Gast has paid 10 Mio Euros into this fund, and the money is to be used by lobbyists and attorneys.

I guess it is just another sign, that the world has gone crazy, instead of considering things and rituals, many people perceive it as an attack.

Given what Puzzle says I have this bad feeling that they'll give in to the will of child-mutilators in the end. :( Hopefully before that happens people will awake to the insanity of these so-called 'religions'.

Just the fact that this outlawing of child torture is causing such an uproar, seems a perfect reminder that most of humanity are nothing more than machines. One would think that any normal caring human being would be revolted at the thought of such a cruel act being perpetrated on a child. But because some "god" in the ancient past supposedly decreed this a sacred ritual - it is "OK" to mutilate an innocent child.
