I think so :)

Free of speech is not being violated by taking legal action against defamers, it is like saying that the ability of parents to care for their children freely is violated when after constant abuse by some parents, the child is taken apart from them, osit.

It is the specific situation that makes it stand as something to take care of, we need to take into account the law of three to not get lost in impasses.
