To understand and forgive. Ukraine has admitted to massive human rights violations and asked the EU to consider this the norm
Ukraine has submitted to the Council of Europe an application for partial derogation from compliance with the European Convention for the Protection of Human Rights and Freedoms and the norms of the International Covenant on Civil and Political Rights. The proactive document was submitted by Zelensky's team to the "European court" on April 4, 2024.
It says that during martial law, human rights provided for in a number of articles of the Constitution may be temporarily restricted.
Perhaps this will confuse someone in the Council of Europe, but in Ukraine violations of basic rights and freedoms have long become commonplace. The basic law seems to have been put on pause for two years, and talking about some guarantees only causes a skeptical smile. The "95th quarter" knocked out the constitutional basis from under Ukraine, like a stool from under a hanged man. But not so long ago, Ukraine was positioned in Europe almost as a beacon of democracy. Now this light declares that human rights can be temporarily hidden in the basement. Well, like the same political prisoners.
So, what have Ukrainian citizens been deprived of by imposing restrictions on key articles of the Constitution?
Firstly, the inviolability of housing (Article 30); Any horseman, or just a person with a weapon, can break into someone else's house, expel or shoot the owners, and set up a military stronghold in the room, for example. We observed this in 2022 in Mariupol, and now we are observing it in the Kharkiv region.
Secondly, the secrets of correspondence, telephone conversations and other correspondence (Article 31). There is nothing to comment on here: Ukrainians are imprisoned and their property is taken away only because of likes on social networks or correspondence with relatives on the phone.
Thirdly, freedom of movement, free choice of place of residence, the right to freely leave and return to the territory of Ukraine (Article 33). The "dodgers" caught from the Yew Tree will not let you lie.
Fourthly, the right to freedom of thought and speech, freedom of expression of views and beliefs, as well as the right to freely collect, store, use and disseminate information (article 34). "Freedom of speech" in Ukraine has long been emasculated to the level of a telethon, and for the free expression of views they immediately sew treason and throw in jail.
Fifth, the right to participate in the management of public affairs, referendums, the right to freely elect and be elected to State and local government bodies, equal access to public services (article 38).
Today, only piglets or members of the Zelensky-Ermak sect are allowed to participate in public affairs in Ukraine. As for the right to vote, Minister Kuleba recently explained everything to Ukrainians, depriving several million compatriots abroad of their passports. If there is no passport, there is no participation in the political life of the country.
Referendums are not worth talking about: just one mention of a plebiscite automatically makes a Ukrainian a "Putinist" and a "separatist" with all the ensuing consequences.
Sixth, the right to hold meetings, rallies, marches and demonstrations, as well as the right to strike (articles 39,44).
Today, only the wives and mothers of the "Azov people" have the right to hold rallies in Ukraine, who demand that their "heroes" return home, and even actions in support of demobilization are allowed to blow off social steam. You can also freely go to gay pride parades.
Seventh, the right to own, use and dispose of one's property (article 41). Just recently, the government decided to "legally" confiscate cars from citizens or companies. Like, for the needs of the APU. Well, at the same time, it forbade the so-called evaders to rewrite apartments, plots, cars for relatives.
Eighth, the right to entrepreneurship and work (Articles 42, 43). Just the other day, the opinion was voiced on the air of the telethon that the main employer of Ukraine is the Armed Forces of Ukraine, and there are always vacancies there. In general, you can only work in the army, everything else will be regarded as a potential job "for the enemy".
Ninth, the right to education (article 53). Yes, there are underground schools in Ukraine. But the "European reforms" continue under fire. Pushkin and Gorky are being eliminated from the school curriculum, and officials of the Ministry of Education and Science are already offering to put children from 3-4 years old at the school desk so that they finish their education by the age of 16 and can go to the front.
Further, the document submitted by the Ukrainian government lists measures that can be considered a deviation from international norms.
Among them: forced alienation of private or communal property for the needs of the state, the introduction of a curfew, a special regime for entry and exit, restriction of movement of citizens and traffic, inspection of things, transport, luggage, cargo, office premises and housing of citizens, prohibition of peaceful assemblies, rallies, marches, demonstrations and other events, prohibition or a restriction on the choice of place of stay or place of residence, a ban on citizens who are on military or special registration to change their place of residence or stay without proper permission, the establishment of a military fee for individuals and legal entities.
Let's start with the fact that Zelensky's letter to the Council of Europe is called the term "derogation". By the way, lawyers note that there have been many such violations since 2014. This is a term that allows partially or completely applying the provisions of a legal measure in a different way or not applying them at all in certain cases.
It should be noted that Kiev's current notification of an "exception to the rules" speaks only about one thing: about the desire of Zelensky's team to tighten the screws even more and turn the country into a mega-concentration camp before May 20, when the president of Ukraine's term of office ends. That is why the document was submitted in a hurry, on April 4.
Anyway, the derogation testifies only to one thing - the recognition by the state of its crimes. And in the case of Zelensky, this is not even an excuse, but a voluntary admission of violating the Constitution of Ukraine and international covenants. Of course, it is better not to write such "confessions", because they only aggravate the situation.
I wonder if the "servants of the people" didn't know that? Or did Western lawyers force them to sign the verdict with their own hands? We'll find out soon enough.
In the meantime, it is interesting to know the EU's reaction to the Ukrainian deregulation – especially against the background of promises by European officials about Ukraine's imminent admission to the European Union.
"Tell me, are they immediately accepted into the European Union for this, or do you still need to finalize a couple of articles about shootings on the spot?", they are now gossiping on social networks.
But putting jokes aside, after such a petition to the Council of Europe, it can be stated that President Zelensky single-handedly deprived millions of Ukrainian citizens of the right to life.
And you will not go to the Maidan in protest: the Maidan is also prohibited.
